A North Carolina judge who presided over a 1994 murder trial has been blocked from answering questions about whether he observed racism in the trial.
The Fayetteville Observer reported that retired Superior Court Judge E. Lynn Johnson was questioned in Fayetteville on Tuesday in the first hearing under North Carolina's Racial Justice Act hearing.
Marcus Robinson was convicted of killing Erik Tornblom in a 1991 robbery. Robinson is black, Tornblom was white.
The law allows death row inmates to argue race played an inappropriate role in their case. Those who are successful can be sentenced to life in prison without parole. About 150 cases are pending.
Robinson says prosecutors illegally prevented black potential jurors from serving on his jury, which had nine whites, two blacks and one American Indian.
