Johnston County District Attorney Susan Doyle is suing a woman who she claims had sex with her husband.
According to the lawsuit, Doyle is suing Christi C. Stem of Prestwick Drive in Clayton. Documents show that Doyle and her husband also live on Prestwick Drive in Clayton.
The lawsuit states that Doyle and her husband, Michael Ross Doyle, were married Aug. 10, 1996. It was during that time that the Doyles became "close friends" with Stem, according to documents.
Mrs. Doyle claims Stem knew of her marriage to her husband, but used that relationship to "willfully and deliberately seduce the Plaintiff's spouse."
In the lawsuit, there is a "request for admissions" form that the defendant is requested to answer in 30 days. Stem will be asked to admit or deny that Doyle came to her about marital problems in 2009 and if she assisted the couple to find a resolution in 2010.
Stem will also be asked to admit or deny that Mr. Doyle "expressed romantic feelings," through electronic messages.
The lawsuit claims that Mr. Doyle and Stem took part in sex acts on more than one occasion while the Doyles were still married. The alleged sex acts took place in Doyle's home and Stem's home as well as hotels in North Carolina.
The lawsuit states, "The acts of sexual intercourse between Defendant and Plaintiff's spouse have caused the Plaintiff to suffer great mental anguish, humiliation, injury to physical and emotional health and the loss of assistance and financial support of her spouse and have resulted in the Plaintiff suffering actual, substantial damages."
Debbie Sandlin, a family law attorney in Raleigh, said North Carolina is one of the few states where these lawsuits are possible.
"All that has to be proven is that the people were still living together as husband and wife and that there was sex," she said.
It's unclear yet how much in damages Doyle is seeking.
NBC-17 talked with both Stem and Doyle, but both women said they had no comment.
